‣General

For use of our MobiFind service (hereinafter "Service") it is necessary to accept the MobiFind privacy policy. As of 01-01-2020, this Privacy policy will be applied, which regulates the collection, treatment and use of your personal and non-personal information as a client of the Service.

MobiFind does not sell your personal information to third parties and will always ask for your consent before using your data for any purpose other than those described in this Privacy Policy.

To process your personal data, MobiFind complies with current, local Dutch and European legislation. Therefore, it adopts the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access and theft of the personal data provided.

According to the nature of the data, the state of the technology and the risks to which they are exposed.

‣Data collected

To use our Service the client must create a profile in order to be able to request the geolocation of a mobile device.
The information (personal or non-personal) collected by the Service will vary.
The personal and non-personal information collected by the Service will reach us in three ways:
1) Data collected automatically 2) Data you voluntarily provided to us and 3) Data provided by third parties.
The automatically collected data will consist of the following:
- The information collected through cookies or similar mechanisms stored on your device, always with your consent. Check our Cookies Policy for more information.
- The IP from which the connection is made, the type of device used and its characteristics, the version of the operating system, the type of browser, the language, the date, the country, the time of the request, the reference URL or the mobile network used (among others).
- Data on the use of the Service and possible errors detected during its use.
- Data on your physical location using different technologies: GPS signals sent by a mobile device or information about Wi-Fi access points or nearby mobile phone antennas. In any case, this data is always collected according to the privacy settings of your device.
The data you provided voluntarily.
This information will consist of:
- Information required by MobiFind for the creation of a client profile needed for our Service, indicating at least the information marked with an asterisk on certain fields: email, name and surname and payment information.
- You must also provide the mobile phone number you intend to locate. You accept that you have obtained that number that you intend to locate in a lawful manner and with the prior consent of its owner.
- In relation to the password, the Client will be responsible for their protection. In that sense, it will assume any damage and prejudice that could be derived from its improper use or from the transfer of it to third parties.
- Information, personal or not, that the messages sent through the contact or opinion channels established in the Service may contain, for example your name, alias or email.
- The email you provide to sign up for the newsletter. If you use the email of a third party, you acknowledge giving your consent for it.
Information provided by third parties
It will consist out of:
- Information provided by payment systems or credit card processors, such as the time of purchase or its amount.
- Information provided such as the time, place and day of delivery provided by other companies.
Third party that consents to the geolocation, will transfer automated information about your device as indicated earlier, your telephone number and your specific and specific geolocation for the moment in which you have agreed to make it known.
In no case will geolocation go beyond the specific moment in which it has been accepted and consented.The third party that does not consent to the geolocation, will give MobiFind automated information about its device as indicated above, its telephone number and the name with which it would have been associated.
You can exercise at any time the rights of access, rectification, cancellation and opposition of your personal data by email addressed to:

‣Rights and purposes

We inform you that the completion of the forms is voluntary. However, if you do not fill in the mandatory fields (marked with an asterisk) the use of the Service will not be possible or will be limited.The personal data you provide to us is incorporated and will be treated in the files owned by Digital Gateway B.V in order to be able to meet your requests, provide the requested service and keep you informed about issues related to the activity of the company and its services.
You can exercise at any time the rights of access, rectification, cancellation and opposition of your personal data by email addressed to us.

‣Age

Regarding the use of the Service, you declare that you are of legal age and that you have the necessary legal capacity to be bound by this agreement and use the site in accordance with its terms and conditions, which you fully understand and recognize.

‣Use of data

MobiFind will use the data collected to:
- Manage, provide and update the Service.
- Perform the requested geolocation, provided it is consented by the recipient
- Address the issues you raise.
- Process the payments you make.
- Send you by email, if authorized or as provided in the applicable regulations, our newsletter and / or offers from our business partners.

- You cannot unsubscribe from certain correspondence from us, such as the messages related to the security of your data or the terms and conditions of the Service and system messages that provide you with data you paid for. Our Service will never SPAM , but if you wish to unsubscribe you can do so by deleting your account. You can do this here.
- Plan and develop the commercial activities of the Service, such as advertising, directly or through third party collaborators.
- Maintain the security of the Service, investigate illegal activities, enforce our terms and conditions and assist the state security forces and bodies in the framework of their eventual investigations.
- Likewise, MobiFind may use the personal and non-personal information of the clients in the form of aggregated and anonymous data to show them to third parties. You may also share statistics and demographic information about clients and their use of the Service with third parties. None of this will allow those third parties to identify you personally.

‣Delete account

You can delete your account here. If you decide to delete your account, all your data will be deleted, including backup copies, within a maximum period of 7 days.

‣Data shared with third parties

There are third parties that manage part of the Service.
MobiFind requires them to comply with this privacy policy as applicable, in addition to having their own. However, MobiFind will not be responsible for compliance with the named policy.
Under some circumstances, MobiFind may share, save or use with third parties any of the personal information collected:

To provide the Service:
The service providers that provide functions on our behalf, such as credit card processing, geolocation process, web hosting, business analytics, customer service or marketing. These service providers may collect and access the information that is necessary to perform their functions, but they are not allowed to share or use the information for any other purpose.

To cooperate with the competent authorities:
If we believe it is reasonably necessary to satisfy any law, legal process or legitimate interest in any part of the world. In any case, we will only provide the strictly required information.
If we believe that this action is appropriate to enforce the terms and conditions of MobiFind .
If necessary to detect or prevent fraud or security related issues of MobiFind , its suppliers and clients.

‣Security measures

MobiFind adopts all the necessary technical and organizational measures to protect the security and integrity of the personal and non-personal information collected. Both against unauthorized access and accidental alteration, loss or destruction.
The sending and remission of data that you make through the Service, is protected by electronic security techniques on the network such as the SSL protocol. Likewise, the information provided and stored in the MobiFind databases is also protected by security systems that prevent access to them by unauthorized third parties.
MobiFind makes its best efforts to have the most up-to-date systems for the effectiveness of these security mechanisms. In addition, MobiFind stores personal and non-personal information for as long as permitted and required by regulations. The one that is not needed is periodically destroyed.
Notwithstanding the foregoing, MobiFind cannot guarantee the absolute security of the information collected, so you must collaborate and use common sense about the information shared at all times.

‣Changes to the Privacy Policy

This Privacy policy may be updated in the future.
We will inform you about your changes by sending a notice to the email address provided and / or placing a notice in a prominent place on our website.

‣Data Protection legislation.

Data protection in the European Union is governed by the General Data Protection Regulations (“GDPR”), which became enforceable in the European Union (“EU”) from 25 May 2018. Under the requirements of the GDPR, an individual’s personally identifiable data (“Personal Data”) (which includes location data) cannot be processed by any business, unless there is a lawful bases for processing the Personal Data as set out in Article 6 of the GDPR:
(a) Article 6 (1) (a) - Consent: the individual has given clear consent for the company to process their personal data for a specific purpose.
(b) Article 6 (1) (b) - Contract: the processing is necessary for a contract the company has with the individual, or because the individual has asked the company to take specific steps before entering into a contract.
(c) Article 6 (1) (c) - Legal obligation: the processing is necessary for the company to comply with the law (not including contractual obligations).
(d) Article 6 (1) (d) - Vital interests: the processing is necessary to protect someone’s life.
(e) Article 6 (1) (e) - Public task: the processing is necessary for the company to perform a task in the public interest or for the company’s official functions, and the task or function has a clear basis in law.
(f) Article 6 (1) (f) - Legitimate interests: the processing is necessary for the company’s legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests.

Company’s policies.
In the Company’s circumstances, the lawful bases of processing the Subject’s Personal Data is ‘Consent’. This is confirmed in the following clauses of the Company’s policies:
(a) Our Privacy Policy; and
(b) Our Terms & Conditions
MobiFind’s operations, and its privacy policy, have legal bases for processing Personal Data under the requirements of GDPR, which is achieved once it has obtained the written consent of the Subject to have his or her location data shared for a specified purpose.
Whilst GDPR applies and is enforceable in the EU only, the regulation is currently the most comprehensive form of data protection legislation globally, and any company that is based in or does business in the EU, is required to comply with GDPR, to the extent that its operations relate to the processing of personal information in the EU.
